WAP Registration Process

You are starting to register for BOOM's WAP information and trading services. For delayed information services, you DO NOT need to register and can simply go to http://wap.boom.com. For WAP stock tracker feature and/or trading services, you need to become BOOM member. Please go to Feature section for detail.

Remarks: You are advised to turn on the security function in the mobile phone to enhance secure transmission of information, data or figures from the handset.

BOOM Disclaimer - Provision of on-line securities trading service through WAP

Customer fully understands the terms contained in the following letter from Boom Securities (H.K.) Limited ("BOOM") and agrees to be bound in accordance with its terms: -

This letter is supplemental to and subject to the terms and conditions of the Boom Client Agreement/Margin Trading Agreement between Boom Securities (H.K.) Limited as Boom/Broker and Customer. All terms used but not defined herein have the respective meanings specified in the Boom Client Agreement/Margin Trading Agreement.

In consideration of our providing to you on-line securities trading service through the Wireless Application Protocol ("WAP") by using mobile telecommunication devices, you hereby agree and confirm that :-

1. Boom Securities (H.K.) Limited and its associated companies and officers (together "Boom") provide no representations, guarantees or warranties, express or implied, regarding the accuracy, correctness, completeness, timeliness, reliability or quality of the contents or service available through WAP (including but not limited to price quotation of securities) or the confidentiality, security or accuracy of information or data (including but not limited to the name, price and quantity of securities) transmitted through WAP;

2. Boom disclaims any warranty, responsibility or liability that any on-line transactions for securities trading through WAP will be fit for any purposes, uninterrupted, error-free or free of any contaminating or destructive properties;

3. Boom shall not be liable in any way to you whether in contract, tort or otherwise for any cost, expense, loss or damage incurred or suffered by you caused by or as a result of :-
(i) any incompleteness, inaccuracies, incorrectness, error, omission, misstatement or delay of any transactions instructed through WAP or the unfitness of the WAP site for any purposes or any failure of any part of the WAP site to be duly stored or transmitted from or to, or received by, you through WAP;
(ii) any failure, delay, interruption to or disruption of the WAP service in the transmission or reception of any data through the WAP site, howsoever caused or arising;
(iii) any defect, deficiency, breakdown or failure of the WAP service or WAP site, or the incompatibility or unsuitability of any software or system in relation to or in conjunction with any other system or equipment (whether used or operated by Boom, you or any other person);
(iv) any defect, deficiency or deterioration in the quality of any signal or data transmitted as part of the WAP service or any loss, corruption or deletion of any data or information (whether belonging to, provided or stored by you or otherwise) transmitted to or stored in any system or equipment (whether or not maintained or operated by Boom, you or any other person) howsoever caused or arising; 
(v) any event the occurrence of which Boom is unable to control or avoid by the use of reasonable diligence, including but not limited to the failure, shortage or interruption of electrical power or supply, riots or civil commotion, strikes, lock outs or trade or labour disputes or disturbances, fire, flood, drought or acts of any government or sovereign, change in any law, war or the defaults, omissions or actions of any licensee, inclement or extreme weather conditions and acts of God; and

4. subject always to the exemptions and exclusions set out in paragraphs 1 to 3 of this letter, nothing herein shall apply to limit or restrict Boom's liability where such cost, expense, loss or damage is incurred or suffered as a direct result of Boom's gross negligence or willful default. However, without prejudice to the generality of the foregoing, Boom shall not be liable for any indirect or other consequential loss or other economic losses (including but not limited to loss of revenue, business, profits or anticipated earnings) or special damages whether arising from negligence, breach of contract or otherwise.

All other terms and conditions of the Boom Client Agreement/Margin Trading Agreement shall remain in full force and effect and unamended.

BNU Disclaimer on Securities Trading 

The disclaimer below is only applicable to users accessing Boom's WAP trading service through BNU's WAP platform.

The Client(s) by signing a "Client Agreement" with Boom Securities (H.K.) Limited ("BOOM") understand and accept that:

1. BNU is not part of that agreement and therefore BNU can not be liable for any loss incurred in relation to the processing of buy or sell orders sent by the Client to BOOM, for cash balances or securities hold in the Client's accounts with BOOM or for the collection of dividends, profits, interest or any other income that they are entitled.

2. For the purpose of transfer funds from or to the Client accounts with BOOM the Client shall maintain a current or a saving account with BNU.

3. BNU is only liable for, under Client instruction, to transfer funds from his current or savings account with BNU to the Client account with BOOM or to credit his current or saving account with BNU, after receiving a credit advice from Boom.com and having received funds that are immediately available.
